These terms of use of the website (hereinafter referred to as the “Agreement”) are entered into between the user (You) and The Christian Broadcasting Network South-East Europe (CBN SEE). By continuing to use the content of the website www.cbnsee.hr, the user accepts the terms and conditions of use stated in the following text of this Agreement:
(1) The user confirms that he has read the terms and conditions of use and accepts them as such. YOU AGREE TO READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS CBNSEE WEBSITE. If you do not accept the stated terms and conditions of use, you are not allowed to access the CBN SEE website or use it in any way.
(2) CBN SEE may monitor your use of this website and may freely use and publish, with or without attribution to you, any information and materials received from you or collected through your use of the CBN SEE website for any reason permitted by law or purposes. However, personal information, other than that which you post yourself through messages or other forms of public communication on the CBN SEE site, will be used in accordance with the CBN SEE Privacy Policy.
(3) CBN SEE reserves the right, at its sole discretion, to change, modify, add or remove any part of this Agreement, including without limitation the Privacy Policy, in whole or in part, at any time. Such changes will be posted on the CBN SEE website. You agree that your continued use of the CBN SEE website will constitute your unconditional acceptance of all such changes, modifications, additions to or removals from this Agreement.
(4) The CBN SEE website is protected by copyright as an overall work and/or compilation, subject to Croatian copyright laws, international conventions and other copyright laws. The contents of the CBN SEE website including, without limitation, text, comments, messages, video content, images, interactive elements and all other materials contained therein (“Content”), are provided AS IS for your information and personal, non-commercial use only. . All Content included on the CBN SEE website is copyrighted and owned or controlled by CBN SEE or the party listed as the Content provider. The User shall comply with any additional copyright notices, information or restrictions contained in any Content on the CBN SEE website. Downloading and copying of one (1) copy of the Content and other downloadable elements published on this CBN SEE site is permitted for personal, non-commercial use only, provided that all copyright and other rights notices listed with such Content. Copying or storing of any Content for purposes other than personal and non-commercial use is strictly prohibited. The content may not be used, copied, displayed, shared, transmitted, published, exhibited, sold, licensed or otherwise used for any other purpose without the prior written permission of CBN SEE or other copyright holder specified in the individual notice. about the copyright of that Content.
(5) In order to be able to register as a user (“User” or “Users”) of CBN SEE, the user must be at least eighteen (18) years old /at least thirteen (13) when using Superbook content/. Where eligibility is determined by law, the user will be automatically barred from registering. The user confirms that all information provided during registration with CBN SEE is true and complete. Commercial companies are not permitted to register with the CBN SEE website unless previously approved by CBN SEE. User registration will be completed upon acceptance of the form by CBN SEE. Other terms and conditions that may apply to your registration will be posted on the CBN SEE website from time to time. The user can cancel his registration at any time, for any reason, by following the instructions on the website. CBN SEE reserves the right to refuse or terminate user registration on the website at any time, for any reason and without notice. CBN SEE also reserves the right to send notices and alerts to users, from time to time, about the use of the website and information about updating and changing settings.
(6) By posting messages, uploading files, entering data or including any other form of communication (individually or collectively – “Communications”) to the CBN SEE website, you hereby grant CBN SEE a permanent, worldwide, irrevocable, unlimited , an unlimited, exclusive, royalty-free license to use, copy, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, edit, incorporate into any works and otherwise exploit such communications, in any media that are currently known or will be subsequently developed (including but not limited to photographs, videos, audio files, text and other materials). You hereby waive all rights to any claim against CBN SEE for any alleged or actual violation of any proprietary right, right of privacy and publicity, moral right and right of attribution in connection with such communications. You acknowledge and agree that transmission to and through the CBN SEE Website is not confidential and that your Communications may be read or intercepted by others. You agree that sending communications to CBN SEE does not create any confidential, fiduciary, implied-in-contract or other relationship between you and CBN SEE except in accordance with this Agreement. You acknowledge and agree that (i) CBN SEE has no obligation to use or respond to any communications; (ii) CBN SEE has and shall have no obligation to review or verify any communications; (iii) CBN SEE does not guarantee the accuracy or quality of communications or that harmful, offensive, illegal or otherwise questionable communications will not appear on CBN SEE’s website; (iv) CBN SEE may monitor any or all Communications in its sole discretion; (v) CBN SEE may remove any communications, in whole or in part, from the CBN SEE website; and (vi) CBN SEE may exclude any person from further use of the CBN SEE Websites.
Responsibility for communications is assumed by the person who uploaded them to the CBN SEE website. CBN SEE disclaims all liability for inappropriate statements or material or inaccurate information contained in any communication.
You represent and warrant that: (a) you have all rights in and to your communications (whether owned or licensed, consented and permitted by the owner) necessary (i) to lawfully transmit your communications to the CBN SEE website and grant the rights to your communications set forth in this Agreement and (ii) to have your communications posted and sent to and through the CBN SEE website for purposes authorized pursuant to this Agreement; (b) you have all necessary licenses, consents, approvals and/or permissions to use the name and/or likeness of any identifiable person in your Communications in the manner authorized by this Agreement and (c) the publication and transmission of your Communications on and through the Website CBN SEE for the purposes authorized by this Agreement do not infringe the privacy rights, publicity rights, copyrights, patents, trademarks, contract rights or any other rights of any person or entity, or violate any law, rule, regulation or provision.
(7) The CBN SEE website is for personal use only and may not be used for any commercial activities or endeavors or the sale of any services or products without our express prior written approval, which may be withheld for any reason.
(9) “CBN SEE” and “CBN” logo are registered trademarks and/or service marks of CBN SEE and CBN. All other trademarks, service marks and logos used on the CBN SEE website are owned by CBN or are used with the permission of their respective owners.
(14) The CBN SEE website contains links and pointers to other related websites, resources and sponsors of the CBN SEE website. Links to and from the CBN SEE website to other third-party sites, maintained by third parties, do not constitute an endorsement by CBN SEE or any of its subsidiaries or affiliates of any third-party resources or their content. CBN SEE disclaims any responsibility for the content contained in any third party material provided through links from the CBN SEE website.
(17) This AGREEMENT IS GOVERNED BY THE LAWS OF THE REPUBLIC OF CROATIA. THE JURISDICTION OF THE COURT IN THE REPUBLIC OF CROATIA IS DETERMINED FOR ALL DISPUTES RELATED TO THIS AGREEMENT.
(18) This Agreement constitutes the entire agreement between CBN SEE and you regarding your use of the CBN SEE website. Any action with respect to your use of the CBN SEE website must be commenced within one (1) year after the claim or cause of action arose or you irrevocably waive your right to bring an action.
Paragraph headings are for reference only and do not in any way determine or limit the scope or meaning of such paragraph. If CBN fails to take action with respect to any breach of this Agreement, you agree that any such failure to act shall not waive CBN’s right to take action with respect to any subsequent or similar breach. If for any reason a court of competent jurisdiction determines that any provision of the Agreement or part thereof is unenforceable, that provision shall be enforced to the fullest extent permitted to achieve the intent of the Agreement, and the remainder of this Agreement shall continue to apply in full force and effect.
